North Macedonia’s Supreme Court Rules Citizens Can Sue State Over Air Pollution-Related Health Issues

In a landmark decision, North Macedonia's Supreme Court ruled that citizens can sue the state for health damage caused by air pollution.

The court reaffirmed the constitutional right to a healthy environment, stating that “the state is obligated to ensure a healthy living environment, including the right to clean air as an individual right of citizens,” according to local media.

The ruling follows lawsuits filed by two citizens who claimed they were forced to breathe heavily polluted air and demanded the state implement a strategic action plan for environmental and public health protection.

Article 43 of North Macedonia’s Constitution guarantees the right to a healthy environment, making this ruling a significant step toward addressing the country’s air quality crisis.
