Lex Specialis vs. Rule of Law

A fast-tracked special law concerning the former General Staff’s land is raising alarms about transparency and governance.

The proposed legislation, bypassing public debate and anti-corruption assessments, would effectively legalize past irregularities while tailoring rules to hidden interests. Critics warn that such measures could set a dangerous precedent, undermining the rule of law and eroding public trust in Serbia’s institutions.

Transparency advocates highlight that the law offers no clear explanation of the intended projects or legal framework, leaving significant ambiguity about its implementation and potential impact on the country’s legal and administrative systems.

For many, the lex specialis reflects a wider trend in Serbia, where opaque decisions and unresolved social tensions have fostered public discontent, protests and uncertainty, casting a shadow over the credibility of the state and its institutions.
